In a case filed on behalf of a trust beneficiary in the Probate Division of the Common Pleas Court of Hamilton County, Ohio, Roy Leonard successfully defeated a motion to dismiss filed by Fifth Third Bank in a case in which the bank, as trustee of multiple Trusts, is accused of breaching its fiduciary duties by failing to diversify the trusts’ equity holdings which resulted in the Trusts permanently losing tens of millions of dollars in asset value.
